01About these terms

These Terms of Service ("Terms") govern your use of the website at dataaifoundry.com (the "Website") and any resources, courses or products offered through it. The Website is operated by Yinks Analytics Inc., a company incorporated in Alberta, Canada, doing business as Data & AI Foundry ("we," "us" or "our").

By using the Website, signing up for a resource or course, or buying a product, you agree to these Terms. If you do not agree, please do not use the Website or our products.

02What we offer

Complimentary resources and courses

We offer complimentary downloads (such as checklists, templates, assessments and guides) and complimentary online courses. You receive these by providing your name and email address. They are covered by the same license terms as our paid products (section 4).

Digital products

We sell digital products, including our Flagship frameworks, the workbooks offered within our courses, and any bundles of these ("Digital Products"). Each product's contents and price are described on its page of the Website or within the course.

Advisory services

We do not currently offer advisory services through the Website. If we offer them in future, they will be governed by a separate written agreement.

03Access and delivery

Digital Products are delivered digitally. After your payment is confirmed, you receive an email with access details, usually within minutes. Depending on the product, this may include online access, downloadable PDF files and editable templates (Excel and Word files that also work in Google Sheets and Google Docs).

Course access is sent by email after you sign up. We may update, reorganize or retire a course or complimentary resource at any time.

If you have trouble accessing something you've signed up for or bought, contact us at contact@dataaifoundry.com and we will help.

04License to use our materials

When you sign up for a resource or buy a Digital Product, we grant you a non-exclusive, non-transferable license to use the materials for your organization's internal purposes. This includes use by your employees and contractors working on your behalf.

You may

• Download, print and customize the materials for internal use
• Share the materials with members of your team within your organization
• Adapt templates and frameworks to suit your needs

You may not

• Redistribute, resell, sublicense or share the materials outside your organization
• Reproduce or republish the materials for commercial purposes
• Present our frameworks or templates as your own original work for external sale or distribution

05Prices and payment

Prices are shown in US dollars (USD) unless stated otherwise. We may change prices at any time. Price changes do not affect purchases already completed.

Payments are processed by third-party payment providers. We do not store your payment card details. Payment is due at the time of purchase.

06No refunds

Because Digital Products are delivered instantly and can be downloaded in full, all sales are final. We do not offer refunds or money-back guarantees on any Digital Product, including frameworks, workbooks and bundles.

Before you buy, we encourage you to try the related complimentary course and resources to make sure a product is right for you.

If a file is damaged, incomplete or does not match its description, contact us at contact@dataaifoundry.com within 30 days of purchase and we will fix or replace it. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.

07Updates to products

We may update our Digital Products from time to time. Where a product page says updates are included, you will receive them at no extra cost. We are not required to notify you of every update, but we will tell you about significant changes by email where possible.

08Nature of our content

All content on the Website, in our resources and courses and in our Digital Products is for general information and education. It is not legal, financial, regulatory or compliance advice. Please get qualified professional advice for decisions with legal, financial or regulatory consequences.

Data, analytics and governance work depends on judgment and on your organization's circumstances. Your results will depend on how you use the materials.

09Intellectual property

All content on the Website, including text, frameworks, templates, graphics, logos and course materials, is owned by or licensed to Yinks Analytics Inc. and is protected by copyright, trademark and other intellectual property laws in Canada and internationally.

Except as allowed by the license in section 4, you may not copy, reproduce, distribute, modify, create derivative works from or publicly display our content without our written permission.

If you send us feedback, testimonials or questions, you give us a non-exclusive, royalty-free, perpetual license to use that content, including in marketing. We will not publish information that identifies you without your consent.

10Disclaimer of warranties

The Website, resources, courses and Digital Products are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. This includes implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not promise that the Website will be uninterrupted or error-free, that any particular result will be achieved, or that all content is complete and up to date at all times.

11Limitation of liability

To the fullest extent permitted by law, Yinks Analytics Inc. and its directors, employees, contractors and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of revenue, data or business, arising from your use of the Website, resources, courses or Digital Products.

Our total liability for any claim relating to these Terms or our products is limited to the amount you paid us in the twelve months before the claim.

Some jurisdictions do not allow these exclusions or limits. In those places, our liability is limited to the fullest extent the law allows.

12Indemnification

You agree to defend, indemnify and hold harmless Yinks Analytics Inc. and its directors, employees and contractors from claims, damages, losses and expenses (including reasonable legal fees) arising from your use of the Website or our products, your breach of these Terms, or your breach of any law or third-party right.

13Third-party links and services

The Website links to third-party websites, tools and services, and uses third-party providers for payments, email and course delivery. We do not control them and are not responsible for their content or practices. Their own terms and privacy policies apply to your use of them.

14Acceptable use

You agree not to use the Website or our products for anything unlawful, fraudulent or harmful, or to disrupt, damage or gain unauthorized access to the Website or its systems. You also agree not to use bots, scrapers or other automated tools to extract content from the Website without our written permission.

15Governing law and disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict of law principles. If you are located elsewhere, some local laws may also apply to you.

We will first try to resolve any dispute through good-faith discussion. If that fails, the dispute will be resolved by binding arbitration in Edmonton, Alberta, except where the law does not allow this. Either party may still seek urgent injunctive or equitable relief from a court.

16Changes to these terms

We may update these Terms. When we make material changes, we will post the updated Terms here with a new effective date, and may also tell you by email. Continuing to use the Website or our products after the changes take effect means you accept the updated Terms.
